2009 SPRING FIREARMS COMPETITION RESULTS

SILVER ALERT PLAN SB 148, the "Silver Alert Plan," is now law. It became effective April 2, 2009, upon publication in the Kansas Register. 

The general premise is for law enforcement, the media, and others to work together to provide public alerts when an elderly person is missing - much like the Amber Alerts for children.

This law is one which we didn't really oppose but formally questioned why they were even doing it and pointing out the problems with the original language. It had many problems at first introduced including mandating certain actions be taken in cases not well defined. They fixed that by simply saying we "may" do what we already could do anyway. The only real part of this bill that does anything is the requirement for the Attorney General to develop a statewide plan. 

SENATE BILL No. 148

AN ACT concerning missing elderly persons; establishing the Kansas silver alert plan.

Be it enacted by the Legislature of the State of Kansas:

Section 1. There is hereby established the Kansas silver alert plan. The Kansas silver alert plan shall be established und implemented by the office of attorney general, in collaboration with the Kansas Bureau of Investigation, Kansas Highway Patrol, local law enforcement agencies and other public and private agencies and organizations. Under the Kansas silver alert plan, public notice of a missing elderly person may be promptly broadcast und a search may be timely undertaken with the cooperation of local law enforcement, news media und the general public in order to locate such person in time to avoid serious harm or death.

Sec. 2. This act shall take effect und be in force from und after its publication in the Kansas register.


COPS GRANT FUNDING:

COPS Office Funding in the American Recovery and Reinvestment Act of 2009

The Office of Community Oriented Policing Services (the COPS Office) is pleased to announce the availability of funding under the COPS Hiring Recovery Program (CHRP). The COPS Office will receive the funds from the American Recovery and Reinvestment Act of 2009 to address the personnel needs of state, local, and tribal law enforcement. Application materials are scheduled to be available before the end of March.

CHRP is a competitive grant program that provides funding directly to law enforcement agencies having primary law enforcement authority to create and preserve jobs and to increase their community policing capacity and crime-prevention efforts. Up to $1 billion in grant funding will be available for the hiring and rehiring of additional career law enforcement officers. There is no local match requirement for CHRP, but grant funding will be based on current entry-level salaries and benefits packages. Any additional costs for higher salaries or benefits for particular individuals hired will be the responsibility of the grantee agency.

Applications for CHRP grants will be accepted only online through the COPS Office web site: www.cops.usdoj.gov. The COPS Office looks forward to working with the law enforcement agencies that apply under this program and will provide technical assistance to applicants during the solicitation process, as requested.

LEGAL ISSUES: Arrests and Detentions of Foreign Nationals
Whenever a foreign national is arrested or detained in the United States, there are legal requirements to ensure that the foreign national's government can offer him/her appropriate consular assistance. In all cases, the foreign national must be told of the right of consular notification and access. In most cases, the foreign national then has the option to decide whether to have consular representatives notified of the arrest or detention.  In some cases, "mandatory notification" must be made to the nearest consulate or embassy "without delay," "immediately," or within the time specified in a bilateral agreement between the United States and a foreign national's country, regardless of whether the foreign national requests such notification.Click here for more information.
